1. Who we are
This website, weightsupply.com (the “Site”), is operated by Dumbbells Direct LLC, doing business as Weight Supply(“Weight Supply,” “we,” “us,” or “our”). By visiting the Site, browsing our blog, or submitting a form, you agree to these Terms of Service. If you do not agree, please do not use the Site.
You must be at least 16 years old to use the Site. The Site is intended for business users — gym owners, dealers, distributors, and other commercial buyers — located in the United States.
2. The site is informational
Everything on the Site — product descriptions, photos, specifications, lead times, blog articles, and any price, price range, or “from” figure — is published for general information and marketing purposes only. It is an invitation to start a conversation, not an offer capable of acceptance.
Nothing on this Site is a binding offer, quote, contract, or guarantee of price, specification, stock, or availability. Pricing, product specification, quantities, lead times, and every other commercial term are confirmed only in a separate written quote or agreement issued by Weight Supply and accepted by you. Those separate documents govern any actual purchase; these Terms govern only your use of this website.
We work to keep the Site accurate and current, but we do not promise it is free of errors or omissions, and we may change, correct, or remove content at any time without notice.
3. Quote requests are not orders
When you submit a form on the Site — the request-for-quote form, a pop-up form, or any other contact form — you are asking us to contact you. You are not placing an order, and no order, reservation, or contract is created by submitting a form.
By submitting a form you consent to be contacted about your request by email, telephone, and text message (SMS) at the contact details you provide, including the phone number you enter. Message and data rates may apply. You can opt out at any time by replying STOP to a text, using the unsubscribe link in an email, or emailing info@weightsupply.com.
You agree that the information you submit is accurate and that you are authorized to provide it — including any business contact details or phone number that belongs to a company you represent.
4. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose, or in violation of any applicable law or regulation.
- Submit false, misleading, or someone else’s personal information through our forms.
- Scrape, crawl, harvest, or bulk-download Site content or images except by ordinary search engine indexing, or use automated means to submit forms.
- Attempt to gain unauthorized access to the Site, our servers, or any connected system; probe or test the Site’s security; or interfere with its normal operation.
- Upload or transmit malware, spam, or any content that is defamatory, harassing, or infringing.
- Copy, republish, or resell Site content or use it to build a competing product catalog or database.
We may suspend or block access to the Site, and refuse to respond to any submission, at our discretion.
5. Intellectual property
The Site and its content — including text, blog articles, product photography, illustrations, layout, design, and software — are owned by Weight Supply or its licensors and are protected by copyright and other intellectual property laws. The “Weight Supply” name, logo, and related marks are our trademarks. You may view and print Site pages for your own internal business evaluation. Any other use — reproduction, distribution, modification, framing, or commercial exploitation — requires our prior written permission.
If you send us feedback, ideas, or suggestions about the Site or our products, you grant us a perpetual, royalty-free right to use them without obligation to you.
6. Third-party links and services
The Site links to third-party sites and embeds third-party services (for example Instagram content and analytics tools). We do not control those sites or services and are not responsible for their content, products, or privacy practices. 7. Disclaimer of warranties
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement, and we do not warrant that the Site will be uninterrupted, secure, or error-free, or that any information on it is complete, current, or accurate.
This section is about the website. Any warranty relating to products you actually purchase from us, if any, is set out in the separate written documents that govern that purchase — not here.
8. Limitation of liability
To the fullest extent permitted by law, Weight Supply and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost business, lost data, or business interruption, arising out of or relating to your use of — or inability to use — the Site, even if we have been advised such damages are possible.
Our total aggregate liability arising out of or relating to the Site and these Terms will not exceed one hundred U.S. dollars (US$100.00). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
9. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Changes take effect when posted. Your continued use of the Site after that point means you accept the updated Terms, so please check back periodically.
10. Governing law and venue
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to the personal jurisdiction of those courts.
If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it.
